In donation after the cardio-respiratory determination of death (DCDD), the legal position is that the donor is dead at the time organs are procured and so the procurement of organs from these donors does not violate the dead donor rule. This position has been subjected to well-known and compelling criticism. Nonetheless, we offer a new argument here in defence of the criterion of permanence for the declaration of death in the case of DCDD donors. We contend that this defence can withstand legal and philosophical challenges.
