Abstract
The Australia-United States Free Trade Agreement required Australia to bring the anti-circumvention provisions of its copyright laws into line with the controversial US Digital Millennium Copyright Act (DMCA). This article examines the history of the final amendments to implement those changes, the debate over the proper scope of the law, apparent reversals of government policy, and concludes that the new state of the law is unclear, uncertain, and creates the opportunity for new and innovative misuses of technological protection measures.
