Description

This thesis explores the law relating to whether parents have the power to consent to the non-therapeutic (non-medical) removal of a male infant’s foreskin via a 'circumcision' procedure. In reviewing relevant Australian legislation and case law it was concluded that non-therapeutic circumcision is arguably beyond parental powers to consent. Male infant circumcision conceivably falls within a class of special medical procedures requiring authorisation of a court. In the absence of legislation, recommendations are made to prohibit the performance of non-therapeutic circumcision on children in Australia.
